Alternative dispute resolution and in particular mediation as the way forward

Disputes between parties are ordinarily taken to Courts for settlement but over the years the court systems world over and in particular Pakistan have become inefficient as well as costly due to backlog of cases and cumbersome procedures. The inefficiency and inadequacy of the court system to provide prompt and appropriate relieves have given rise to ALTERNATIVE DISPUTE RESOLUTION. Conciliation, mediation and arbitration are all forms of alternative dispute resolution as oppose to conventional form of settlement i.e. litigation. There is a great deal of confusion among people as to the difference between these alternative forms of dispute settlement. The talk will try to cover these different forms of alternative dispute resolutions, their usage, distinctions and advantages. It will discuss in detail that how the settlement under Mediation differs from arbitration, negotiations and conciliations, in its procedures and effectiveness.

A practicing advocate of the High Courts since 1998 in the area of corporate, commercial, constitutional, regulatory and environmental laws. In addition to litigation has also been involved in transactional work and development consultancies, with a special interest in regulatory regime, environment, land acquisition and SMEs. Has been closely associated with formation and setting up of numerous not for profit organization including PMI Lahore Chapter. Has a keen interest in academia and has taught administrative, constitutional, environmental law etc at LUMS, TILS, UCL, Civil Services Academy and the Judicial Academy and has had special training environmental law. She is an accredited mediator from the Centre for Effective Dispute Resolution (CEDR), an international dispute resolution center based in UK..
